We reserve the right to deny anyone service or remove content at our sole discretion, especially content that is deemed inappropriate, offensive, harmful, defamatory or obscene.

Accounts & Storage

The amount of storage space and bandwidth per member may be limited depending on your membership. Accounts may be archived, or materials may be purged at such time intervals as Dreamartist Films or its third party service provider(s) determine in their sole discretion.

Some materials may not be stored, served or processed due to space constraints, serving/bandwidth limitations or disruptions in the system(s). You agree that Dreamartist Films is not responsible or liable for the deletion or failure to store, serve or process any materials or other information nor hold us liable for disruption of the service. We recommend always keeping archives of your material on your local hard drive.

You should realize that all of your content is publically available on the web including password protected videos. Do not upload material you do not want anyone else to see. Although we go through great lengths to secure your accounts and information, we cannot be held liable if anyone accesses your content or private data when done in a manner beyond our control.

Accounts may be terminated at anytime at our discretion or if you violate these terms of service. In the event of a suspension or deletion of an account, materials may no longer be accessible.

Beta Testing

If you sign up during Beta, certain features may be completely altered or disabled upon the next version. When beta testing period is over we may charge a monthly fee for the future use of this service, which you will be allowed to accept or decline. Otherwise we will control the advertisement spot and may offer the service for free.

Content

Since we cannot review all submissions to the site, we are not responsible for the content uploaded by users. We will not be held liable for content generated by users in any manner whatsoever.

We have the right to remove content that violates these terms of service as well as delete accounts and remove associated content at our discretion. We shall not be liable to you or any third-party for any termination of your access to the services.

If you are to integrate embedded video into your channel that is hosted elsewhere, you are responsible to read the terms of service of the web site that hosts your video to ensure you are using the video appropriately.

Disclaimer

Dreamartist Films and its service providers are not responsible for any defects or failures associated with the Services, including, without limitation, the email service, or any damages (such as lost profits or other consequential damages) that may result from any such defects or failures.

Refund Policy

You may cancel your account at anytime, but we are not obligated to issue refunds for disruption of service or for any other reason. The user may be issued a refund for one month term if your account is deleted for non-violation of these terms of service and may not be issued a refund for deletion of your content or account if you violate these terms of service. Users are only allowed a one month trial costing $1.00. If you attempt to register for a trial more than once you may not be issued a refund. Users will not be allowed a refund on the charge associated with the one month trial. Prices are subject to change at anytime.

Indemnity
You agree to defend, indemnify and hold harmless Dreamartist Films, its affiliates, and their respective officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs and expenses (including but not limited to attorney's fees) arising from: (i) your use of the Website; (ii) your violation of these Terms & Conditions; (iii) your violation of the terms which apply to your User Submission; (iv) your violation of any third party right, including without limitation any copyright, property, publicity or privacy right; or (v) any claim that one of your User Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms & Conditions and your use of the Website.
